Terms of Service

These Terms of Service ("Terms") govern your access to and use of NotMyOutage (the "Service") operated by NotMyOutage("we", "us", or "our"). By using the Service or joining the waitlist, you agree to these Terms. If you do not agree, please do not use the Service.
1. The Service
NotMyOutage is an independent status tracker that aggregates publicly available information from third-party status pages (including Cloudflare, Vercel, and OpenAI). We are not affiliated with, endorsed by, or sponsored by those providers.
The Service is provided for informational purposes to help you determine whether issues you experience may be caused by upstream providers. It is not a substitute for official vendor status pages, support channels, or your own monitoring.
2. Eligibility
You must be at least 16 years old and legally capable of entering into a binding agreement to use the Service. You represent that any information you provide (including your waitlist email) is accurate.
3. No guarantee of accuracy
Outage data is sourced from third-party status pages. We do not guarantee that the information displayed is complete, current, error-free, or correctly classified. Delays, omissions, or misclassification may occur. You use the Service at your own risk when making operational or business decisions.
4. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
5. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) FIFTY UNITED STATES DOLLARS (USD $50).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
6. Acceptable use
You agree not to:
- Scrape, crawl, or automate access to the Service in a way that burdens our systems
- Attempt to gain unauthorized access to our systems or data
- Use the Service for unlawful purposes or to harass others
- Reverse engineer or copy the Service except as permitted by law
- Resell or misrepresent our data as official vendor status information
We may suspend or block access if we reasonably believe you are violating these Terms.
7. Waitlist
If you join the waitlist, you consent to our processing of your email and preferences as described in our Privacy Policy. Joining the waitlist does not guarantee that any particular feature will launch, on any timeline, or at any price. We may remove waitlist entries at our discretion.
8. Intellectual property
Status information displayed on the Service originates from publicly available third-party sources. Our website design, branding, code, and original presentation are owned by us or our licensors. You receive a limited, non-exclusive, revocable license to access the Service for personal or internal business use.
9. Third-party links
The Service may link to official vendor status pages and other third-party websites. We are not responsible for their content, policies, or availability.
10. Privacy
Our Privacy Policy explains how we handle personal data and is incorporated into these Terms by reference.
11. Termination
We may modify, suspend, or discontinue the Service (in whole or in part) at any time. You may stop using the Service at any time. Sections that by nature should survive (including disclaimers, limitation of liability, and governing law) will survive termination.
12. Governing law and disputes
These Terms are governed by the laws of Georgia, without regard to conflict-of-law rules. Exclusive jurisdiction for disputes shall lie with the courts of Tbilisi, Georgia, unless mandatory consumer protection laws in your country require otherwise.
13. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
14. Changes to these Terms
We may update these Terms by posting a new version on this page with an updated effective date. Continued use after changes constitutes acceptance where permitted by law.
